Background

This action by the Board took her completely by surprise, as she had not received any prior notification. The Board asserted that an Accusation, a formal charging document, had been sent to her recorded address, and that she had a 15-day window to respond – a window that had long since closed without her knowledge.
Challenges
The primary challenge in this case was the nurse’s lack of awareness of the Accusation due to a failure in receiving the Board’s correspondence. This lapse led to the automatic revocation of her license without her having the opportunity to defend herself. Our task was not only to address the revocation but also to prove that our client had never received the Accusation, thereby justifying the need to vacate the default decision.
Our Approach
Recognizing the urgency and severity of the situation, our office swiftly filed a Motion to Vacate the Default Decision and Order against her license. This motion was critical to reverse the immediate consequences she faced and to reopen her case for proper adjudication.
