Case Study: Unlocking a California Real Estate License

At Unlock Legal, we enjoy having relationships with our clients. Sometimes these relationships grow as we represent clients over several years for a variety of issues. This real estate professional was one of these clients.

In 2014, a California realtor hired us because the Department of Real Estate (DRE) denied his license application due to previous convictions. A couple of years prior, he’d been convicted of a vandalism charge in state court, and this mistake was now impacting his professional career.

As a result of working with our experienced license defense attorneys, his vandalism charge was expunged from his record. Then, we were able to defend the denial of his license and get him a restricted license. A restricted license with the California DRE meant he had all the rights and privileges of a fully licensed real estate agent but was deprived of his due process rights for a certain period. After receiving his license, he proceeded with his career.

During his two-year probation, this real estate client recruited our team again to assist with the documentation needed for his new job and to help renew his professional license. The DRE requires professionals to disclose past convictions and probationary status when partnering with a new brokerage. Our team was able to provide the proper disclosure information and assist with his license renewal.

At the end of his two-year period, it was time for this client to convert his restricted license to an unencumbered license. To remove restrictions, we filed a petition for reinstatement with the DRE, and it was granted. He is currently a practicing real estate agent with a fully unencumbered license.

We’ve stood before licensing boards to petition for reinstatement, fight against license denial, and even manage administrative hearings when a professional’s license is under investigation.
